MAKING THE PRESENCE OF THE RUSSIAN CITIZENSHIP OF A CHILD WHOSE PARENTS ARE CITIZENS OF THE RUSSIAN FEDERATION
According to article 12 of the Federal law “On citizenship of the Russian Federation” the child born in the territory of the foreign state gets citizenship of the Russian Federation by birth if on birthday of the child:
— both his parents or the only parent have citizenship of the Russian Federation (regardless of the place of birth of the child);
— one of his parents has the citizenship of the Russian Federation, and the other parent is a stateless person or is recognized as missing, or his location is unknown (regardless of the place of birth of the child);
If both parents are citizens of the Russian Federation, the Consulate General may issue a Russian birth certificate if the American birth certificate has not been issued.
If the child has already received an American birth certificate, the Russian certificate is not issued. In this case for registration of existence of the Russian citizenship are represented:
— birth certificate the Names of the parents specified in the birth certificate of the child must exactly match the names specified in the Russian passports. In case of discrepancy, the documents confirming the name change are submitted. Please note that if the American birth certificate of the child contains the mother’s maiden name, then when submitting the documents, you must also attach the mother’s birth certificate (original and copy) and marriage certificate (original and copy), or notarized copies of these two documents;
— application of one of the parents in the form number 5(if You have a program Acrobat Reader, this form can be downloaded by clicking the FORM № 5 on registration of the child of Russian citizenship in one copy. The application is notarized.
— three passport size photos (for children over 6 years old);
— a statement addressed to the Consul-General V. N. The kids from the citizen, in whose passport the child is fit, with a request to write in his passport child (son/daughter name of child). The application is filled in any form in Russian. *
— application addressed to the Consul General from the second parent that he does not object to the entry of the child in the passport of the spouse (the form is arbitrary); in case of impossibility of the personal presence of one of the parents when applying for citizenship of the child, the application is notarized;
— passport of the parent in whose passport the child fits;*
— consent of a child aged 14 to 18 years to acquire citizenship of the Russian Federation, drawn up in any form. The consent must be notarized. Children from 14 to 18 years need to issue a separate passport, the entry into the passport of parents is not made;*
— the original and a copy of the passport of the second parent, confirming his Russian citizenship at the time of birth, and at the time of application for registration of the child of Russian citizenship;
— The procedure for registration and the amount of payment depend on each case and require an explanation of the employee (tel. 323-650-2233).
In the presence of the relevant circumstances, instead of the consent of the other parent, the court decision on the recognition of this parent as dead or missing, or on the deprivation of his parental rights or the death certificate of this parent, or a statement drawn up in any form, the absence of the applicant’s information about the location of this parent or a document confirming that the applicant is a single mother shall be submitted.
Consideration of applications for citizenship of children aged 14 to 18 years and decision-making on them is carried out within a period of up to six months from the date of application and submission of all necessary documents, duly executed. Consideration of applications for citizenship of children under the age of 14 years and taking decisions on them is carried out within two months from the date of application and submission of all necessary documents.
*If necessary, the child may be issued a separate passport of a citizen of the Russian Federation. The procedure for registration and the amount of payment depend on each case and require an explanation of the employee (tel. 323-650-2233)
RECEPTION IN CITIZENSHIP OF THE RUSSIAN FEDERATION CHILDREN, ONE OF PARENTS OR THE ONLY PARENT WHOM IS A CITIZEN OF THE RUSSIAN FEDERATION
According to the Federal law of the Russian Federation «On citizenship of the Russian Federation» which came into force on July 1, 2002, the children living outside the Russian Federation who are foreign citizens or stateless persons are accepted in citizenship of the Russian Federation according to the application of one of parents, or the only parent who has citizenship of the Russian Federation,
The following documents are submitted:
— Application form No. 3 in duplicate (if You have an Acrobat Reader program, this form can be downloaded by clicking FORM No. 3). The application is signed only by a parent who is a citizen of Russia;
— Three passport size photos (for children over 6 years old);
— Passport and a copy of the passport of the parent having the citizenship of the Russian Federation, as well as a copy of the American document entitling to permanent residence in the United States;
— Birth certificate the Names of the parents specified in the birth certificate of the child must exactly match the names specified in the Russian passports. In case of discrepancy, the documents confirming the name change are submitted. Please note that if the American birth certificate of the child contains the mother’s maiden name, then when submitting the documents, you must also attach the mother’s birth certificate (original and copy) and marriage certificate (original and copy), or notarized copies of these two documents;
— Identity document and citizenship of the other parent(if the other parent is a foreign citizen);
— Consent of a child aged 14 to 18 years to acquire citizenship of the Russian Federation, drawn up in any form. The consent must be notarized.
— Together with the statement of the parent having citizenship of the Russian Federation, the written consent of other parent having other citizenship on acquisition by the child of citizenship of the Russian Federation is also submitted. Such consent shall be given in any form. The signature of the application shall be certified by a notarial record.
In the presence of the relevant circumstances, instead of the consent of the other parent, the court decision on the recognition of this parent as dead or missing, or on the deprivation of his parental rights or the death certificate of this parent, or a statement drawn up in any form, the absence of the applicant’s information about the location of this parent or a document confirming that the applicant is a single mother shall be submitted.
— Payment. The procedure for registration and the amount of payment depend on each case and require an explanation of the employee (tel. 323-650-2233).
Consideration of applications for citizenship of children aged 14 to 18 years and decision-making on them is carried out within a period of up to six months from the date of application and submission of all necessary documents, duly executed. Consideration of applications for citizenship of children under the age of 14 years and taking decisions on them is carried out within two months from the date of application and submission of all necessary documents.
Similarly, children and incapacitated persons over whom guardianship or trusteeship is established are admitted to Russian citizenship. Applications in this case are submitted by guardians or Trustees having citizenship of the Russian Federation.Consideration of applications for citizenship of children aged 14 to 18 years and decision-making on them is carried out within a period of up to six months from the date of application and submission of all necessary documents, duly executed. Consideration of applications for citizenship of children under the age of 14 years and taking decisions on them is carried out within two months from the date of application and submission of all necessary documents.
